Can non-residents buy property in Australia?

Yes - foreign residents, temporary residents and short-term visa holders can buy investment properties and residential real estate in Australia, provided they have permission from the Foreign Investment Review Board.

What types of properties can be purchased?

In December 2015, the Australian Government introduced new legislation for foreign investors to purchase Australian property.

Under the new laws, non-resident buyers can only invest in new dwellings, off-the-plan properties under construction or vacant land with a view to development.

Non-residents are not permitted to buy established dwellings unless they plan to demolish said dwelling and construct a new one within four years of receiving approval from the Foreign Investment Review Board.

Non-residents who purchase property in Australia are required to seek approval from the Foreign Investment Review Board unless an exemption applies.

FIRB Exemptions

Foreign investors who wish to purchase residential real estate within Integrated Tourism Resorts do not require approval from the Foreign Investment Review Board. Hope Island, Sanctuary Cove & Royal Pines residential resorts on the Gold Coast in Queensland are Integrated Tourism Resorts in Australia.
